Hi fellow bros, my friend got some problem and the only place tat i can think of to seek advise is tis forum.

My friend know a KTV girl a a month ago, and they hav been very close. But yesterday tis girl went to with a customer for dinner, tis girl only met the customer once in the KTV a month ago and yesterday was the second time they went out. During the first time they met, the guy bring the girl to some beach n gave the girl $400 (i dunno for wat), later he ask for FJ but the girl refused n run away. But the guy chased her n she was so scared but managed to go home safely. Then yesterday the guy called tis girl again n said he will giv her money if she meet for dinner. So they met up n aft the dinner he man got hold off her handbag n detain her passport. He guy then threatened her if she dun giv him a FJ he will not return the passport. So finally he man got the FJ (wis CD or not, dunno). Aft the FJ, the guy still did not rtn her the passport n said will giv her back whenever he feel like it.

So my question is wat can the girl do now? The girl now jus wan to get back her passport n the FJ jus forget abt it. My advise is to report police abt the passport.

Any advise can help my friend n the girl? The detail story i am not very clear also. If possible, pls PM me cos i afraid tat the guy also read tis forum. Thanks.

Wat did the girl do wrong to deserve it? Even KTV is also human and even foreigner is protected by our law. Even the girl work in KTV is illegal, it is up to the police to charge her not us to bully her, they still do not deserve tis kind of treatment. police r not stupid. booking out for dinner and drinks can cost as much as $400 for some midrange ktvs. if she is working here without a work permit, the police wont care. tell the girl not to worry. they will concentrate on the big matter. rape, battery, criminal intimidation, etc r not small matters. she is also human, regardless where she is from. she deserves justice. the punishment is too much for whatever she had done wrong to the guy.:mad:

The customer was not right, but the KTV girl is also guilty of both stupidity and greed. But we don't argue about whose fault is this... now as I see it, she is in a lan-lan situation. She can either put up with it, or make sure both die together.

When you take the risk of working illegally in a foreign country, you are subject to another risk that the locals will take advantage of the fact that you are trying to avoid attention by the authorities and thus they can do what they like to you. So conduct yourself properly, don't give people a reason to tekan you. Don't cheat others. Because the evil that you do can and will be returned double.

Simple as abc, make a police report stating lost of passport with the report go to the embassy n get a temp "passport" for her to go back to her country.

A legal standpoint based on what was posted.

1. A foriegn passport was illegally withheld, not amounting to theft as it was handed over with full knowledge from the girl. This is still a criminal offence and must be reported to the police, who will arrest the offender should his mailing address be provided.

Failing which, the police will search for him at his known whereabouts or trace him through his registered phone number, failing which a composite recreation of his face will be created or should the girl remember which meeting place she met him, should it be fitted with security cameras, would be of great help to the investigation. Any other bits of detail of her time with him would be of great help.


2. Unfortunately, other 'criminal offences' listed on the post are only based upon the words of the girl. Under singapore law, one is guilty until proven innocent, thus should she complain about being abused, it is a criminal offence, and the police will have to act accordingly, arrest the guy and prepare for prosecution in a court of law.

However, the girl will have to engage a lawyer to prove beyond reasonable doubt that she was forced into the degrading act by him, of which the judge will then have to take into the account of the guy's words as well - paid money for it, and her profession is a KTV hostess, went willing to meet up with him, and had a sexual liason in a location she agreed to go to willingly and not forced to go. ( she will have to show evidences of being forced to go, if not, the defendant's lawyer will rip her testimony apart)

Suggested course of action:

1. Get a lawyer to acertain her rights and her case before reporting to the police as she is a foreigner and working as a hostess in Singapore. The lawyer will treat any information as confidential and will not reveal to the police, unless a serious crime has been committed such as murder or treason.

2. Singapore is a law and order society. Best to engage police to assist in criminal offences assistance than 'brother' associations. Police assistance is free, while using other associations, one may have to pay in cash or 'in kind' - more expensive than you may realize.

3. Most important of all - inform her to tell the truth, whether did she had the passport illegally withheld, or lost the passport, or had her passport visa expired, then use a stupid excuse to see if there is any other way to escape Immigration law by using you to search here for an answer.

All the best, and if her story is true of being abused, then may the guy have a good time in Changi Prison with butt-loving inmates.

If you are talking about the crime itself, the onus of proof mostly rest with the prosecution. The special element of the offence of rape would sometimes require the victim to proof certain part of the facts.

If you refer to sexual battery, under the torts of trespass to person(s), then the picture might grey up a little. However, the indications one gets from other jurisdictions would be that the onus of proof rest with the Defendant and not the Claimant. Further, the standard of proof would be on the usual ground of balance of probability.
