Re: Rape trial in Singapore

Married man who forced himself on woman escapes rape charge 19 Jan 2012 A married man & a woman met online, chatted over the Internet 4 2 months b4 deciding 2 get 2gether in person. On their 1st date, they went 2 a karaoke pub & then walked on the beach on Sentosa, where they kissed. Ng Han Tong, 37, tried touching the 31-year-old woman inappropriately tat nite, but she resisted & he stopped. They were chatting online the next day when he suggested tat they meet again, & assured her they would only kiss. She agreed 2 see him. But their 2nd date in 2 days ended with the woman resisting his advances in a Chinatown hotel room b4 telling the police tat he had raped her. Ng, also known as Jimmy Ng, was 1st charged with rape, but the prosecution later reduced the charge 2 1 of aggravated outrage of modesty. The IT analyst pleaded guilty & was on Wednesday sentenced to 3 years in jail & 6 strokes of the cane. The maximum penalties 4 the offence r a jail term of betw 2 & 10 years + caning. The court heard tat Ng & the woman met online in January 2010 & went on their 1st date in March. On their 2nd date, the following day, they went 2 a pub b4 checking in2 the Hotel 81 Cosy in Jiak Chuan Road. The court heard tat the woman agreed 2 go 2 the hotel becos he said they would just spend time kissing. 1s in their hotel room, they began kissing. But Ng then progressively removed all of the woman's clothes, even though she tried 2 push him away. Ng took off his clothes 2, & ignored the woman when she said she did not 1 2 hv sex with him. The court heard tat Ng kept trying 2 persuade her 2 perform various sex acts & she resisted most of his suggestions. At 1 point when he was on top of her, Ng ignored her attempts 2 push him away & went ahead 2 hv sex. He did not use a condom. Afterwards, the woman got dressed, left the hotel alone & took a taxi home. She went 2 the police the next day & reported him 4 rape. It is unclear why the sex act in tis case was eventually treated as outrage of modesty instead. Defence counsel R.S. Wijaya said the decision was made @ the prosecution's discretion & the plea offered to his client. Lawyers who spoke 2 The Straits Times noted tat it is rare 4 rape charges 2 be reduced. The penalty 4 rape is a jail term of up to 20 years, a fine & caning. Pleading 4 leniency, Mr Wijaya said that @ the time of the offence, Ng was suffering fr an adjustment disorder, a short-term condition tat develops when a person is unable 2 cope with a particular source of stress. He said Ng had been stressed & unhappy becos he & his wife had been unable 2 hv a baby. The couple had resorted 2 various means 2 conceive, including taking traditional Chinese medicine, & were intending 2 start assisted-reproduction therapy. They had met thru friends in 2004 & registered their marriage in 2007. The court heard tat Ng's wife, also an IT analyst, had forgiven him. In a letter submitted to the court, she described him as a 'caring & understanding husband'. She said he had apologised 2 her & she did not wish 2 divorce him. She also described him as a filial son, popular among his colleagues & 1 who made time 2 support charitable causes such as the Sunlove Senior Activity Centre 4 the elderly & needy families. Bros,be careful. when a woman allow a man 2 kiss her,it doesn't imply she allows the man 2 up her. when a woman checks in2 a hotel with a man,it doesn't imply she allows the man 2 up her. Is it worth all these shits jz 2 get a free bonk ? not 4getting the 3 yrs jail & 6 strokes of the cane. |

Re: Rape trial in Singapore
i sympatized with the woman if she indeed been raped, but again i stressed that it could b a way woman try to extort money from the guy or trying to damage his reputation....i think that guy had some wealth......we are living in modern society, anything is possible when it comes to money and sex....i do not believe the woman in this story...why went to the man house initially in the wee hours....

Re: Rape trial in Singapore
If she didn't want sex, why did she checked into the hotel with him and allowed him to remove her clothes?

Man found guilty of raping woman he met at Zouk appeals against conviction
02 Apr 2012 SOURCE: The Straits Times Was a 22-year-old woman raped by a man she met at a nightclub or did she have sex with him willingly? That was the issue before the High Court on Friday when it heard the appeal of convicted rapist Ong Ming Wee, 29, who is fighting his conviction and sentence of seven years' jail and eight strokes of the cane for rape. He had failed to convince a district court during the trial last year that the woman had consented to having sex hours after they met at Zouk disco in 2009. On Friday, his lawyer Subhas Anandan argued that the woman, who cannot be named, had consented to sex. Mr Anandan pointed out that surveillance footage in the club showed that she had danced very closely to his client, who felt that she was trying to seduce him. The lawyer said the pair had kissed during the taxi ride back to Ong's Toa Payoh flat after leaving the club. Mr Anandan said she was crying rape only because Ong threw her out after they had sex and she was angry at being treated as a tool. He added that Ong - who helps run a family-owned mini-mart in Toa Payoh North - did not use violence or any weapon against the woman. But Deputy Public Prosecutor Leong Wing Tuck pointed out that the rape took place more than two hours after the dancing and there was a 'cooling-off period'. While Ong had not used physical violence or threatened her explicitly, he was in a position of dominance over the woman, who was intoxicated, said the DPP. The DPP pointed out that Ong had told her that he would allow her to make a phone call to her mother if she had sex with him; this showed he was in control. The DPP said the woman's mindset was that of a 'trapped animal' and that she was 'overawed into submitting' to Ong. Justice Quentin Loh reserved judgment. However, he told both sides to make written submissions on a provision in the Penal Code which states that a person has not committed an offence if he had acted in mistaken belief. http://thecourtroom.stomp.com.sg/stomp/courtroom/case_of_the_day/1038104/man_found_guilty_of_raping_woman_he_met_at_zouk.ht ml

Re: Rape trial in Singapore
Quote:
a few points brought up by the defense lawyer shed more doubts on the female victim rape allegation. 1 was : if she could contact her mum/friend, why she did not called mata instead ? but the accused family had 2 spend an addition $70k for the appeal. it was reported that in total $130k was spend on engaging lawyers to fight the case . |

Re: Rape trial in Singapore
below were copied fr yesterday's mandarin newspaper.
his defense lawyer in the appeal highlighted tat there r 8 points of doubts. |
