The solicitor, in his late 60s and identified only as AVB, sued the young sex worker, known as TDD, for breach of confidentiality at the High Court after she found information about past liaisons on his laptop. Senior judge Mr Justice Tugendhat, who granted the pair anonymity, said TDD broke a duty she entered when she accepted money for sex. But while her conduct amounted to a breach of AVB’s right to privacy, the judge said he would not receive damages because although he experienced ‘some embarrassment’ he ‘has suffered no real distress.’ The judge said the couple met in March 2012 when he responded to one of her escort agency adverts. AVB, who has three children, is said to have paid TDD around £20,000 in cash and gifts, and even arranged sexual encounters over Skype. The court heard he even acted as her solicitor for a time. TDD, who came to England to study when she was 18, was said to have sent messages to his work colleagues alleging he had had sex with secretaries, clients and trainees of his firm. He warned her against blackmailing him. But she accused him in evidence of being a 'manipulator and a bully’, which the judge accepted. The judge said sex between them was not entirely consensual because: 'AVB manipulated and deceived TDD into giving consent by other promises of assurance, of payment, or of help in her career.' 'She turned to prostitution to make a living,’ said the judge. 'But she kept it a secret from her parents, who would disapprove, and a secret from the prestigious London college where she was studying. He also made ‘entirely unwarranted’ threats including to sue her for defamation/ She asked him for help with her legal studies and he had at first encouraged her expectations and introduced her to a relation who was a Queen Counsel. She then gave up a job worth £1,000 because she could not do it ‘emotionally while thinking of seeing you.’ ‘She said she could be an exclusive girlfriend or a w***e, and he had to choose,’ said the judge. After one quarrel he bought her a £1,000 necklace from Selfridges, said the judge. She sent information she found on AVB’s computer and memory sticks to his daughter and work colleagues, said the judge, In his judgment she was in breach of her duty of confidentiality in disclosing that information to third parties. But the confidentiality agreement she signed was unenforceable on grounds of public policy because it purported to give up her right to complain of suspected exploitation. He said: ‘TDD has shown herself to be erratic and unpredictable, and ready to disclose private and confidential information when provoked by AVB’s conduct.’ The judge said: ‘I have also found that AVB took pleasure in provoking TDD’s anger and other emotions, and it would not be just that he should receive damages for those occasions when his provocations resulted in the excessive reactions which I have found.’ He said AVB was entitled to an order restraining TDD from further disclosing any confidential or private information already disclosed by her which relates to AVB’s wife and his children. She was also forbidden from passing on sexual or financial information relating to individuals with whom he has had a sexual or a personal or professional relationship. But he was not entitled to an order restraining publication of any of the other information on which she based her complaints against him.
