Man on trial for abducting and raping unconscious woman 15 years younger

SINGAPORE: A 40-year-old man is on trial for allegedly abducting a 22-year-old student from the club Zouk under the guise of sending her home, and raping her while she was intoxicated and unconscious.

Bunker surveyor Ong Soon Heng had brought her to his house at 4 Hume Heights, where he allegedly committed the crime. The victim was found about two hours later by her boyfriend, who had tracked her down using the Find My iPhone app.

“A night of revelry and fun took a dark turn for the victim in this case," Deputy Public Prosecutor Sellakumaran Sellamuthoo said at the opening of the trial on Thursday (Mar 30).

The High Court heard that Ong had plied the victim with drinks on Jul 24, 2014, while they were at the club with friends. When the victim passed out drunk at about 4am, Ong told their friends he would see her home. They did not object, because Ong and the victim were known to be “good friends”.

CCTV footage showed Ong carrying the victim’s limp body out of the club and into the backseat of his car. They left Zouk at about 4.04am. The victim never made it home.

Ong, who was “desirous of winning the victim’s affections”, took advantage of the situation and brought the victim to his house, where he allegedly raped her between 4.04am and 6.30am.

Prosecutors said the victim’s boyfriend, who had not joined the party at Zouk, became worried when he did not hear from her and could not reach her. He used the Find My iPhone app to track her down to 4 Hume Heights, where he found the victim lying in Ong’s bed, still unconscious.

She was found dressed in Ong’s T-shirt and boxers, but the 40-year-old denied he had done anything to her.

About eight hours after the rape, the victim’s blood alcohol concentration was 62mg per 100ml of blood. Doctors estimated that during the rape, the victim’s blood alcohol concentration would have been about 210 to 254mg per 100ml of blood.

A psychiatrist will testify that the victim would have been in “a severe state of alcohol intoxication with significantly impaired consciousness” at the time, prosecutors said. “Therefore, it is highly unlikely that the victim would have consensually participated in sexual intercourse (that day).”

The High Court heard that Ong, a divorcee, was romantically interested in the victim 15 years his junior. He had persisted in his advances even though he knew the victim had a boyfriend and was not interested in him.

The victim tolerated Ong’s advances so as not to jeopardise her internship at an F&B company whose owners were friends with the accused, prosecutors said.

The prosecution’s first witness was the victim’s friend who was at the club that night. She testified that Ong had plied the victim with drinks until she was “very tipsy”. “He put his arm around her (the victim) and put the cup to her lips,” she said.

Different case though circumstances bear similarities. Your case involve younger man and clothing brand model. We can assume women want to have sex with him. The recent case in this thread involve 40 yr old divorcee uncle - less likely to be equally attractive.

Lesson learned : free sex is fun but can bite you in the arse if it involves tipsy women. Want to bonk, best to go for FL / WL, and also save money in long run (no need spend on clubbing and sian-ning the girl).

Actually facts not as reported as I know both the accused and the victim. We share the same social circle and are business associates of the victim's employers. It became a police case because of a jealous boyfriend and pressure from her family to report as rape. From what I know the victim was planning to break with her boyfriend and go steady with the accused and they had both gone out on dates with each other prior to the incident. The accused has been supporting the victim financially as she is still studying. To be charged for rape is too harsh in this case as I would classify it as a case of SB/SD relationship whereby a jealous boyfriend found out about the arrangement and brought the girl's father into the picture and he pressured her to lodge a report in order to save the familys' "face".

I suppose it can be humiliating for the family to accept that their girl look for SD. Also for the BF.

Yet 22 yr old is not a kid already. Can be pressured to make false claim?

If what you say is true hope justice prevail in the end. The 40 yr old uncle also learn lesson ... if want to bonk 22 yr old syt, FL got a lot out there, and can change when bored. Being SD is more expensive and more trouble than worth and only get to bonk one pussy!

Today's news also highlighted the fact of how easily traceable we are through our mobiles. Want to do naughty things, best switch off the mobile.

Sure bo? If it is like what you said, the accused would be quite easy to provide financial records and evidences in chats or whatever communication medium to back this claim since he has been providing the victim with money. Cannot be at this information age, there is ZERO trail leading to the accused unable to establish his defence on this matter. Unless the latter is damn stupid to transact all in cash.

The girl was about to break up with her bf and have been having SB/SD relationship with the 40yrs old yet did not change her iphone password to disallow his bf to track her down?

New law defines contempt of court, spells out penalties

SINGAPORE — Against a backdrop where social media could quickly amplify opinions on ongoing court cases, the Government has introduced a Bill to spell out when these comments would be in contempt of court by dint of prejudicing the outcome of the case.

The Administration of Justice (Protection) Bill, which was introduced in Parliament on Monday (July 11), also sets out two other types of contempt of court, namely, when court orders are not complied with and when judges are accused of bias or impropriety without basis.




If the Bill is passed, contempt of court will become a criminal offence, where the range of penalties are laid out. Currently, the Attorney-General’s Chambers (AGC) seeks the court’s consent to commence contempt of court proceedings and the punishment is at the discretion of the judge hearing the case.

Speaking to the media after the Bill was tabled, Law Minister K Shanmugam said the proposed law does not “create anything new”, rather, it “crystallises the current legal position”. He added: “It is the one area of criminal law which is based on judge-made case law and we thought it’s time to make sure that’s crystalised, put in the framework, set out the law as it is in writing.”

The Bill states that as soon as a writ is filed for civil proceedings or when a suspect has been charged with a criminal offence, individuals cannot comment on the case — relating to guilt or facts that have not been established by a court — or it would constitute sub judice, which falls under contempt of court. The curb is lifted only when the court proceedings have concluded, such as after an appeal has been heard and decided.

Mr Shanmugam noted that the proposed law does not constrain the right to criticise a judgment or law. What it does is to make it clear that an individual cannot say, without basis, that a judge is biased or motivated by personal considerations because there is a “need to maintain the integrity of the judiciary and protect (them from this) sort of allegations,” he added.

Should there be a genuine complaint about the judge, there are appropriate channels to deal with it, such as the Corrupt Practices Investigation Bureau.

Under the Bill, the High Court or Court of Appeal will be able to fine a person up to S$100,000 and/or jail of up to three years for contempt. Other courts such as the State Courts will be able to impose fines up to S$20,000, and/or jail of up to 12 months.

Other enforcement measures proposed include an apology to the court. The court will decide on the form of the apology, such as face-to-face before a judge, or a notice published in the newspapers. The Bill also clarifies the defence for each type of contempt. For example, fair and accurate reporting of court proceedings is not considered contempt.

Asked if the influence of social media has made it more urgent to enact court contempt into the statutes, the Ministry of Law said the matter has been “in the works for several years”.

In 2010, then Chief Justice Chan Sek Keong had mooted the idea during his speech at the opening of the legal year.

The issue of sub judice — where public discussion of a case under judicial consideration may affect or prejudice the outcome of proceedings — has prompted several warnings in recent years from the AGC.

For instance, in 2013, the AGC urged the public and media not to make or report any statements on the pending Coroner’s Inquiry into the death of American researcher Shane Todd that could be construed as an attempt to “improperly influence the decision” of the State Coroner, or cast aspersions on the independence of the proceedings. Earlier this year, when Mr Shanmugam addressed public discussions on the Benjamin Lim case, he said false allegations had been spread by some parties.

Commenting on the move to enact legislation on contempt of court, criminal lawyer Rajan Supramaniam said it will ensure people will not “recklessly make comments”.

Law Society president Thio Shen Yi added: “The common law already defines the law of contempt, but a statute consolidates the law in one place.”

Ms Tania Chin, a partner with Withers KhattarWong, said the pace at which information gets uploaded on social media these days means that unverified information can spread quickly. “There is a need to ensure that opinions and pieces about a case do not unfairly prejudice the accused person or litigant,” she added.

This is a fucking disgraceful law designed to silence ppl.

Sometime it is hard to understand why people would spend few hundreds or even thousands making a women dead drunk and pound on a died fish. Will it be better to spend much less on WL or willing party. This is classic example of small head taking over. In this case, everyone involve lose !
